Changes to New York State Income Cap Figures

Approximately every two years, New York State adjusts the income cap figures for Child Support and Spousal Maintenance (formerly known as “alimony”) based upon the Consumer Price Index.

Both Child Support and Spousal Maintenance are calculated using statutory formulas as developed by New York State. Additionally, the guideline duration of post-divorce Spousal Maintenance is determined by an Advisory Schedule based upon the duration of the marriage.

Effective on March 1, 2026, the new income cap for Child Support is $193,000.00 (previously $183,000.00) and the new income cap for Spousal Maintenance is $241,000.00 (previously $228,000.00).
